Applies to: the nailfair.com website and the Nailfair mobile app (iOS & Android)

1. Acceptance of Terms

By accessing or using the Nailfair website and app (the “Service”), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your place of residence) to create an account and post listings. You represent that the information you provide is accurate and kept up to date.

3. Accounts

You are responsible for keeping your login credentials secure, including your password and two-factor authentication (2FA) codes, and for all activity that occurs under your account. Notify us immediately if you suspect any unauthorized access to your account.

4. Nature of the Service

Nailfair is an intermediary platform that helps users post and discover listings (nail salons, professionals, events, jobs, suppliers, brands, and classifieds). Nailfair is not a party to any transaction between users. We do not own, control, or guarantee any goods, services, job postings, or businesses listed. All transactions, agreements, and payments between parties are solely their own responsibility.

5. User-Submitted Content

  • You are solely responsible for the content you post and represent that you have the legal right to it.
  • You grant Nailfair a non-exclusive, royalty-free, transferable license to host, display, distribute, and promote your content as needed to operate the Service.
  • We reserve the right (but have no obligation) to review, refuse, hide, or remove content that violates these Terms or the law, without prior notice.

6. Prohibited Content & Conduct

You may not post or engage in:

  • Content that is illegal, deceptive, fraudulent, false, or misleading.
  • Goods or services that are prohibited or restricted by law (weapons, drugs, counterfeit or banned items, etc.).
  • Content that infringes the intellectual property or privacy rights of others.
  • Pornographic, hateful, discriminatory, harassing, or threatening content.
  • Spam, duplicate listings, or false contact or pricing information.
  • Distributing malware, or interfering with, scanning, or reverse-engineering the system.
  • Collecting other users’ data without authorization.

7. Plans & Payments

  • Nailfair offers Free, Premium ($25), and Professional ($49) plans with different benefits and durations (e.g., 365-day listing visibility, priority in search, verified badge).
  • Fees are charged in USD and processed through Stripe (a third-party payment provider).
  • Paid plans are one-time purchases for the stated duration and do not auto-renew. When a plan expires, you must purchase again to continue.
  • Refunds: Fees paid are non-refundable once a listing has been activated, except where required by law.

8. Reviews

Reviews and ratings must be honest and based on genuine experience. Fake, paid, or manipulative reviews are prohibited.

9. Intellectual Property

All trademarks, logos, design, source code, and content created by Nailfair are owned by Nailfair and protected by law. You may not copy or exploit them without permission.

10. Mobile App Terms

  • We grant you a personal, non-exclusive, non-transferable license to use the Nailfair app on your device.
  • App Store (Apple): These Terms are between you and Nailfair, not Apple. Apple has no obligation to provide maintenance or support for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you comply with the applicable App Store terms of service.
  • Google Play: Installing and using the app via Google Play is subject to the Google Play terms.
  • You may not copy, modify, reverse-engineer, or redistribute the app.

11. Disclaimer

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Nailfair does not warrant that the Service will be uninterrupted or error-free, or that user-submitted content is accurate, lawful, or reliable.

12. Limitation of Liability

To the fullest extent permitted by law, Nailfair is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including disputes between users.

13. Indemnification

You agree to indemnify and hold Nailfair harmless from any claims arising out of the content you post, your use of the Service, or your violation of these Terms.

14. Termination

We may suspend or terminate your account if you violate these Terms or the law. You may stop using the Service and delete your account at any time.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California and applicable United States federal law. Any dispute shall be resolved before the competent authorities of the State of California, USA.

16. Changes to These Terms

We may update these Terms. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
